CurbOver Messenger — Acceptable Use Policy

What’s in this acceptable use policy?

This acceptable use policy sets out the rules for using the CurbOver Messenger application and the messaging service hosted at matrix.curbover.com (collectively, our platform). It applies to anyone who uses the platform.

Who we are and how to contact us

The platform is provided by CurbOver (“we”, “us”, “our”). To contact us, please email info@curbover.com.

By using our platform you agree to comply with this policy

By using our platform, you confirm that you accept this acceptable use policy and agree to comply with it. You must be at least 16 years old to use our platform. If you do not agree, you must not use the platform. You are responsible for ensuring that anyone who accesses the platform through your account or internet connection is aware of this policy and complies with it.

This policy refers to our Privacy Policy, which explains how we use your personal information.

We may make changes to this policy

We may amend this acceptable use policy from time to time. Please check this page regularly to ensure you understand the terms that apply.

We may suspend or withdraw the platform

We do not guarantee that the platform, or any content on it, will always be available or uninterrupted. We may suspend, withdraw or restrict all or any part of the platform for business and operational reasons, and will try to give reasonable notice where we can.

You must keep your account details safe

You must treat your password and encryption keys as confidential and not disclose them to any third party. Use cross-signed device verification for devices accessing your account, and periodically review and remove unused, lost or stolen devices. We may deactivate or delete your account if, in our reasonable opinion, you have failed to comply with this policy. If you know or suspect that anyone else knows your password or encryption key, contact us promptly at info@curbover.com.

Open-source software

CurbOver Messenger is open-source software, derived from the Element X client and licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). Nothing in this policy is intended to conflict with that licence, and in the event of any conflict the applicable open-source licence prevails. The corresponding source code is made available in accordance with that licence.

Do not rely on information on the platform

Content on the platform is provided for general information only and is not advice on which you should rely. We make no representations or warranties that content is accurate, complete or up to date.

User-generated content is not approved by us

The platform may include information and materials uploaded by other users. Such content has not been verified or approved by us, and the views expressed by other users do not represent our views.

Reporting content

If you become aware of any material on the platform that may constitute or relate to child sexual abuse or exploitation, terrorist content, or any other illegal content, please contact us at info@curbover.com.

Uploading content to our platform

Whenever you upload content or contact other users, you must comply with the “Prohibited uses” and “Content standards” sections below. You retain ownership of your content, but you grant us a limited licence to use, store and copy it as needed to operate the platform and deliver it to your intended recipients. You are solely responsible for securing and backing up your content.

Prohibited uses

You may not use our platform:

  • In any way that breaches any applicable local, national or international law or regulation.
  • In any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • To harm or attempt to harm minors in any way.
  • To bully, insult, intimidate or humiliate any person.
  • To send or upload any material that does not comply with our Content standards.
  • To transmit unsolicited or unauthorised advertising or promotional material (spam).
  • To knowingly transmit viruses, trojans, worms, keystroke loggers, spyware or other harmful code.
  • In any way that involves child sexual exploitation or abuse, or terrorist content.

You also agree not to reproduce, duplicate, copy or resell any part of the platform in contravention of this policy, and not to access without authority, interfere with, damage or disrupt the platform, the servers on which it is stored, or any connected network or software.

Content standards

These standards apply to any material you contribute. A contribution must be accurate (where it states facts) and genuinely held (where it states opinions), and must comply with applicable law. A contribution must not:

  • Be defamatory, obscene, offensive, hateful or inflammatory.
  • Bully, insult, intimidate or humiliate; promote sexually explicit material or violence.
  • Include child sexual abuse material.
  • Promote discrimination based on race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability or disease.
  • Infringe any copyright, database right or trade mark of any other person.
  • Be likely to deceive any person, or impersonate any person or misrepresent your identity or affiliation.
  • Promote any illegal content or activity, or advocate, promote or assist any unlawful act.

Breach of this policy

When we consider that a breach of this policy has occurred, we may take such action as we deem appropriate, including temporary or permanent withdrawal of your right to use the platform, removal of your content, a warning, legal proceedings, or disclosure of information to law enforcement where necessary or required by law.

No viruses; no unauthorised access

You must not misuse the platform by knowingly introducing malicious code, attempting to gain unauthorised access, or carrying out denial-of-service attacks. We will report any such breach to the relevant authorities. Please report security vulnerabilities responsibly to info@curbover.com.

Our trade marks

“CurbOver” and the CurbOver logo are trade marks of CurbOver. You may not use them without our approval.

Which laws apply

This acceptable use policy, its subject matter and formation (and any non-contractual disputes or claims) are governed by the laws of India, and the courts of Bengaluru, Karnataka shall have exclusive jurisdiction.
